ZOVI Terms of Service
These Terms of Service (“Terms”) govern your access to and use of ZOVI, including the Discord bot, web dashboard, APIs, and related services operated as part of METAVERSE ULTRA (the “Service”). By inviting the bot, signing in to the dashboard, redeeming a plan code, or otherwise using the Service, you agree to these Terms, our Privacy Policy, and Discord’s Terms of Service and Developer Policy.
1. Acceptance of terms
If you do not agree, do not invite or use ZOVI. If you configure ZOVI for a Discord guild, you represent that you have authority to accept these Terms for that guild or entity.
These Terms should be read together with the ZOVI Privacy Policy. If there is a conflict on a privacy topic, the Privacy Policy controls for that topic.
2. Operator identity
The Service is provided by ZOVI. Contact details for legal and support inquiries appear in the “Contact” section and in our Privacy Policy.
[JURISDICTION PLACEHOLDER] Governing law, venue, and entity registration details will be specified in an updated version of these Terms when ZOVI’s operating entity is finalized.
3. Eligibility and age requirement (13+)
You must be at least 13 years old, and old enough to use Discord under Discord’s Terms of Service and the laws of your country, to use ZOVI.
If you are under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian to the extent required by law, and only if Discord itself permits your use.
We may suspend or terminate access if we reasonably believe you do not meet age or eligibility requirements.
4. Discord Developer Policy and platform rules
ZOVI operates on Discord. Your use of Discord remains subject to Discord’s Terms of Service, Community Guidelines, Developer Policy, and other platform rules.
You agree not to use ZOVI in any way that would cause ZOVI or you to violate Discord’s rules, including prohibitions on self-bots, abuse of APIs, unauthorized scraping, spam, or distribution of malware.
We may modify, limit, or discontinue Discord-facing features to remain compliant with Discord platform requirements. Verification materials should reference these Terms and the Privacy Policy URLs on the production website.
5. Bot invite and permissions
Inviting the ZOVI bot to a Discord server requires appropriate Manage Server (or equivalent) permission on that server. You are responsible for reviewing the permission scopes requested at invite time and for configuring role hierarchy so the bot can perform only the actions you intend.
Certain features may request privileged intents (such as Message Content or Server Members) or elevated permissions (for example, moderation or channel management). Privileged intents are opt-in in the Discord Developer Portal and must be enabled before the bot requests them. Grant least privilege consistent with your intended use.
You represent that you are authorized to invite the bot and to allow processing of server member and message data as described in the Privacy Policy.
6. Accounts and dashboard access
Dashboard access uses Discord OAuth when application credentials and encryption configuration are present. We create sessions tied to your Discord identity and guild memberships refreshed from Discord.
Guild isolation is enforced: you may only manage guilds present in your refreshed Discord memberships. Product-owner console access, where offered, is limited to Discord user IDs listed in operator configuration (for example PRODUCT_OWNER_IDS).
You are responsible for maintaining control of your Discord account and for all activity under your sessions. Notify us promptly of suspected unauthorized access.
We may deny, suspend, or revoke sessions for security, abuse, inactivity, or Terms violations.
7. Acceptable use
You agree not to: (a) use the Service for unlawful, harmful, fraudulent, or abusive purposes; (b) harass, threaten, or exploit others; (c) attempt to bypass rate limits, entitlements, tenant isolation, or security controls; (d) reverse engineer the Service except where mandatory law permits; (e) interfere with or disrupt the Service or Discord; (f) upload or transmit malware; (g) use the Service to spam, raid, or mass-abuse Discord communities; (h) misrepresent affiliation with ZOVI; or (i) use AI or automation features to generate content or actions that violate Discord rules or applicable law.
You may not use ZOVI to run opaque automated severe punishments based solely on unverified AI suspicion where the product suppresses such paths.
Server administrators are responsible for their community’s configuration of moderation, protection, broadcasts, giveaways, tickets, and similar tools, including compliance with local law and Discord rules.
8A. No refunds, credits, or chargebacks
ALL ACCESS IS FINAL. To the maximum extent permitted by law, ZOVI does not offer refunds, returns, exchanges, account credits, prorations, or partial refunds. This covers redeem codes, plan unlocks, donations, complimentary access, and any fee you pay ZOVI, whether or not you used the Service, removed the bot, closed a server, or changed your mind.
Paid checkout is not enabled. If ZOVI later accepts payment, those charges are also non-refundable to the maximum extent permitted by law, including when a feature is partial, a Discord action fails, a provider is unavailable, the Service is interrupted, or you stop using it.
You agree not to initiate a chargeback, payment dispute, or reversal. Doing so is a breach of these Terms. ZOVI may suspend or terminate access, revoke codes and entitlements without compensation, and recover the disputed amount plus the reasonable cost of responding to the dispute.
Support messages, Discord chat, dashboard copy, and staff replies do not create a refund right. Only a written statement signed by the operator that expressly grants a specific refund can do so, and ZOVI has no obligation to issue one.
Where a non-waivable consumer law requires a remedy ZOVI cannot waive, that remedy is limited to the minimum the law requires. Every other claim for money back is waived. Asking to delete data, close a server, or stop using ZOVI is not a refund request that ZOVI must pay.
9. Service availability (partial / honest status)
THE SERVICE IS PROVIDED ON AN “AS AVAILABLE” BASIS. Many modules are Partial or Incomplete: for example, some Discord side effects (ticket channels, certain moderation punishments, welcome delivery, music playback, live AI model calls, object-storage-backed restores, or payment capture) may be unavailable, dry-run only, or dependent on credentials and verified bridges.
ZOVI aims to report status honestly (including Not configured, Missing credentials, Partial, Incomplete, or Unavailable) rather than inventing successful Discord actions or fabricated AI replies. You acknowledge that feature catalogs, dashboards, and documentation may describe planned behavior that is not yet end-to-end operational.
We do not warrant uninterrupted, error-free, or fully featured operation. Maintenance, Discord outages, provider outages, and configuration gaps may limit functionality without liability to the maximum extent permitted by law.
10. AI features disclaimer
Optional AI-related features (configuration planning, chat assistance, knowledge stubs, or similar) may produce inaccurate or incomplete results and may be disabled without credentials or health checks.
You remain solely responsible for reviewing AI suggestions before applying them to a live Discord server. ZOVI is not liable for moderation, configuration, or content decisions you make based on AI output.
11. Intellectual property
ZOVI, METAVERSE ULTRA, and related names, logos, software, and documentation are owned by ZOVI or its licensors. These Terms do not grant you ownership of the Service.
You retain rights in content you submit, but grant ZOVI a limited license to host, process, and display that content solely to operate the Service for your guilds, subject to the Privacy Policy.
12. Third-party services
The Service interoperates with Discord and may optionally integrate other providers (hosting, AI, storage, music, and similar). Third-party terms and privacy policies govern those services. ZOVI is not responsible for third-party platforms’ acts or omissions.
13. Termination
You may stop using the Service at any time by removing the bot, signing out, and discontinuing dashboard use. You may request deletion of ZOVI-stored personal data as described in the Privacy Policy, subject to legal exceptions.
We may suspend or terminate access immediately if you violate these Terms, if required by Discord or law, or if continued operation creates risk to the Service, Discord users, or third parties.
Upon termination, licenses granted to you end. Provisions that by their nature should survive (including limitation of liability, indemnity, and governing-law placeholders) will survive.
14. Indemnity
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless ZOVI and its operators, affiliates, and agents from and against claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service; (b) your Discord servers’ content and conduct; (c) your breach of these Terms or of Discord’s rules; (d) your infringement of third-party rights; (e) disputes between you and members of servers where ZOVI is installed; or (f) any chargeback, payment dispute, or refund demand you initiate.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZOVI AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY; OR FOR SERVICE INTERRUPTION; ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZOVI’S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO ZOVI FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE CLAIM (IF ANY) OR (B) FIFTY U.S. DOLLARS (US $50). BECAUSE PAID CHECKOUT IS NOT ENABLED YET, MANY USERS WILL HAVE PAID ZERO, AND THE CAP IN (B) MAY APPLY. THIS CAP INCLUDES ANY CLAIM FOR A REFUND, CREDIT, OR CHARGEBACK THAT IS NOT REQUIRED BY A NON-WAIVABLE LAW.
Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted.
16. Disclaimer of warranties
EXCEPT WHERE PROHIBITED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will meet your requirements, that Discord actions will always succeed, that security planners will prevent all raids, that tickets will meet SLAs without correct staff process, that AI plans are error-free, or that Partial/Incomplete modules will become complete by any date.
17. Changes to the Terms
We may update these Terms from time to time. The “lastUpdated” field indicates the effective date of the current version. Material changes will be posted in the Service or otherwise communicated when appropriate.
If you continue to use the Service after changes become effective, you accept the revised Terms, except where applicable law requires additional consent.
18. Contact
For questions about these Terms, contact ZOVI at: [email protected] (placeholder — replace with the production contact address before public launch), or through the support channel published on the ZOVI dashboard or official Discord presence.
